1. Introduction^‍

These Booking Terms and Conditions set out the basis on which Regency Luxury Villas Ltd acts in relation to enquiries and bookings for accommodation. Please read them carefully before making a booking.

Nothing in these Terms and Conditions is intended to exclude or limit any statutory rights you may have as a consumer.

All enquiries and bookings are subject to acceptance of these Agency Terms and Conditions.

2. Definitions

In these Terms and Conditions:“Client”, “you” and “your” refer to the person making the booking and all members of their party.
“Owner” refers to the legal owner of the property concerned or any person or entity authorised to act on the owner’s behalf, including managing agents or trustees.
“Regency Luxury Villas”, “we”, “us” and “our” refer to Regency Luxury Villas Ltd.

3. Agency Status and Contractual Relationship

Regency Luxury Villas Ltd acts exclusively as a booking agent and payment agent on behalf of property owners.

We do not own, lease, operate or manage any of the properties listed or promoted. Your accommodation contract is formed directly between you and the property owner. Regency Luxury Villas Ltd is not a party to the accommodation contract.

The identity of the property owner may not be disclosed prior to booking confirmation due to privacy and security considerations. The absence of prior disclosure of the owner’s identity does not affect the formation, validity or enforceability of the accommodation contract.

4. Enquiries and Booking Acceptance

All booking enquiries are submitted to the relevant property owner or their authorised representatives for consideration. Acceptance or refusal of any booking rests entirely with the owner.

Provisional bookings typically require confirmation within 48 hours. If confirmation is not received within this period, availability may be released and the property offered to other prospective guests or booking agents.

5. Payments

A booking deposit of 30% of the total rental price is required to proceed with a reservation. The deposit is payable to Regency Luxury Villas Ltd acting solely as payment agent on behalf of the property owner.

Any payments received by Regency Luxury Villas Ltd are accepted solely in its capacity as booking agent on behalf of the property owner and are transferred in accordance with the owner’s instructions for the purpose of securing the reservation.

The balance of the rental price must be received no later than eight weeks prior to the rental start date, unless otherwise agreed with the owner.

Failure to make payment when due may result in cancellation of the booking at the owner’s discretion and in accordance with the owner’s terms.

Arrival and access details will be issued only once all sums due, including any security deposit and excluding bank charges, have been received in full.

6. Late Bookings

Bookings made within eight weeks of the rental start date are treated as late bookings. In such cases, full payment is required within 24 hours, unless otherwise agreed with the owner.

7. Security Deposit

A refundable security deposit is required for each booking. Unless otherwise specified by the owner, this is typically a minimum of 20% of the rental value and must be received no later than four weeks prior to arrival.

Regency Luxury Villas Ltd may hold the security deposit as agent on behalf of the owner. Subject to owner authorisation, deductions may be made for loss, damage, breakages, additional cleaning or other costs incurred during the stay. Any remaining balance is ordinarily returned within approximately four weeks of departure.

Failure to pay the security deposit when due may result in cancellation at the owner’s discretion.

8. Nature and Use of the Property

The Client acknowledges that the property is a private residence offered for self-catering holiday accommodation and not a hotel. Properties reflect the personal taste, architecture and furnishings of their owners and are not subject to standardised international rating systems.

The property is reserved exclusively for the persons named on the booking confirmation. No additional persons may stay at the property without prior written approval from the owner or their authorised representatives.

Guests are required to treat the property and its contents with reasonable care. While routine cleaning is not required, guests remain responsible for stains, damage or breakages caused by members of their party.

9. Behaviour

The owner or their authorised representatives may require termination of a booking if the behaviour of the Client or any party member is, in the reasonable opinion of the owner, likely to cause damage, danger or serious nuisance.

Immediate termination applies only in exceptional circumstances involving wilful damage, serious disturbance to neighbours, or conduct threatening property or personal safety. Such action requires documented evidence and immediate owner notification. In these circumstances, no refund, compensation or reimbursement shall be payable.

Adults are responsible for supervising children at all times.

10. Swimming Pools and Wet Areas

Children must use swimming pools only under the continuous supervision of a responsible adult. All guests must exercise due care in and around swimming pools and wet areas.

Regency Luxury Villas Ltd accepts no liability for accidents or injuries arising from use of pools or wet areas, save where liability cannot be excluded by law.

11. Pets

Pets are not permitted unless expressly agreed by the owner in advance. Where permitted, additional conditions may apply, including deep-cleaning charges and liability for damage caused.

12. Access

The owner or their authorised representatives may access the property at reasonable times, upon at least 24 hours’ notice where practicable, for inspection, maintenance, repairs, meter readings or other reasonable purposes. In emergencies, access may be required without prior notice.

13. Changes and Cancellations by the Client

All cancellation or amendment requests must be made in writing and take effect on receipt.

Cancellation terms are determined by the property owner. Due to the nature of high-value properties booked well in advance, payments are generally non-refundable and remain subject solely to the owner’s discretion, as disclosed at the time of booking.

Amendment requests are subject to owner approval and availability and may incur owner and administration fees.

Bookings commencing within 14 days of being placed are not subject to any cooling-off period.

14. Changes and Cancellations by the Owner

If the owner needs to make a significant change to, or cancel, a confirmed booking, you will be notified as soon as reasonably practicable. Where alternative arrangements are offered, Regency Luxury Villas Ltd may assist with communication only.

Any refunds are the responsibility of the owner. Regency Luxury Villas Ltd accepts no liability for consequential losses such as travel or ancillary costs. Travel insurance is strongly recommended.

15. Force Majeure, Building Works and Local Conditions

Neither the property owner nor Regency Luxury Villas Ltd shall be liable for any failure, delay, disruption or reduction in enjoyment of the accommodation arising from events or circumstances beyond their reasonable control.

Such events include, but are not limited to, government or municipal action, changes in law or regulation, travel restrictions, acts of nature, weather conditions, utility interruptions, infrastructure works, labour shortages, strikes, public works, and construction, renovation or development activity carried out on or near the property by third parties.

The Client expressly acknowledges that properties are often located within established or developing residential, resort or coastal areas where construction and infrastructure works are common and may commence without prior notice. Neither the property owner nor Regency Luxury Villas Ltd has control over, or the ability to prevent, such works, nor can they guarantee advance notification.

No representation is made that construction, renovation or other disruptive activity will not occur during the period of stay. Noise, vibration, visual disturbance, restricted access or other inconvenience arising from such activity shall not constitute a breach of contract and shall not give rise to any right to compensation, refund, price reduction or early termination. The foreseeability or ongoing nature of any such event shall not affect the application of this clause.

Where reasonably practicable, Regency Luxury Villas Ltd will endeavour, at the Client’s request, to assist by communicating reported issues to the property owner or their authorised representatives. Any such assistance is facilitative in nature only and does not constitute property management, supervision, or acceptance of responsibility for the condition, maintenance or performance of the accommodation.

16. Complaints

Any issues arising during a stay must be notified promptly while the Client is in residence. Regency Luxury Villas Ltd will endeavour to assist by referring the matter to the owner or their authorised representatives. Failure to report issues during the stay may affect the ability to investigate and may reduce or extinguish any entitlement to compensation.

17. Insurance

Clients are strongly advised to arrange comprehensive travel insurance, including cover for cancellation, personal belongings, personal liability and accidental damage. Neither the owner nor Regency Luxury Villas Ltd provides insurance cover.

18. Passports, Visas and Health Requirements

Clients are responsible for ensuring that all party members hold valid passports, visas and comply with applicable health requirements. Any information provided is for general guidance only and may change.

19. Third-Party Travel Agents

These Terms and Conditions apply equally to bookings made by third-party travel agents acting on behalf of their clients. The booking agent is responsible for ensuring their client is aware of and agrees to these Terms. The accommodation contract remains between the end client and the property owner.

20. Limitation of Liability

Regency Luxury Villas Ltd shall have no liability to the Client other than for the performance of its agency services. Any liability, to the extent it cannot be excluded by law, shall be limited to the total amount paid to Regency Luxury Villas Ltd in connection with the booking.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or for fraud.

21. Intellectual Property

All website content is protected by copyright and intellectual property laws. Content may be downloaded for personal, non-commercial use only. No ownership rights are transferred.

22. Governing Law and Jurisdiction

These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of the English courts.
